Living Together Increases

Figures from the Office for National Statistics (ONS) released on 4th November 2016 show that cohabiting couple families are the fastest growing family type in the UK in 2016.  The number of cohabiting couple families (with or without children) has more than doubled in the last 20 years, from 1.5 million in 1996 to 3.3 million in 2016.

What many people do not realise when setting up home as a cohabiting couple  is that the rights and responsibilities of cohabitees are not the same as married partners. There remains no such thing as ‘common law marriage’.

Whilst there is increasing pressure on the government to amend the law to give rights and responsibilities to cohabiting partners, when and if there will be any change is far from clear.

Couples considering living together can and should give thought to their situation.  Sadly, relationships, whether you are married or living together, do sometimes come to an end.  You should therefore give consideration at the outset to that possibility.

Couples buying a property can purchase that property in equal or unequal shares to reflect both initial and ongoing contributions to the property.  Cohabitees can also enter into a Living Together Agreement to set out how finances are to be dealt with during their relationship and should the relationship break down.  It may not be romantic but can avoid a lot of heartache and possibly costly legal proceedings in the future.  Such an agreement can also ensure that both parties and children are properly provided for should a relationship come to an end.
