What is a right to light?
A legal right to light is ensured by the Prescription Act 1832. More than half of a room should receive natural light if it is within a residential home or a commercial property, and any person who has enjoyed uninterrupted light through an opening for over 20 years has a right to light – although there are certain criteria that need to be met. These include that the light has been enjoyed:
- Without specific content
- Openly
- Without threat
- Without interruption
It is not impossible, however, for a newer building – one that does not adhere to the 20-year limit – to qualify for rights of light, as there are other ways of obtaining them, including by:
- Express grant
- Implied grant
If a development infringes on a neighbour’s right to light, this could lead to a dispute. As part of this dispute, the neighbour could seek a court injunction in an effort to have the development cut back, ensuring the light to the premises is maintained. In some instances, however, the most appropriate solution can involve compensation. A right to light claim can be brought if just one room is impacted by a development.
