Why might I need a Deed of Variation?

If you’ve inherited money, property, other assets or belongings under a Will or via the rules of intestacy, you can use a Deed of Variation to give some or all the inheritance to another person or organisation.

There are good reasons why a Will may need to be altered after death, for example:

• To clarify an area of uncertainty in a Will.
• To provide for someone who was left out of a Will or due to intestacy
• To make the Will or intestacy more tax-efficient

It may be the case that the family all agree about what they intended to do with the estate, but the Will is insufficiently clear. Alternatively, a beneficiary may decide that they want their inherited share to pass directly to their children. A Deed of Variation can deal with these situations.
