Why might someone want to transfer equity?
As noted above, a transfer of equity can be the requisite course of action for various reasons. Among the most common are:
- To add another individual to the title of a property
- It is required on marriage
- It is required on divorce
- For the release of funds from a property
- It is required on death
What can make the process more complex?
While the process is relatively straightforward when there is no mortgage on the property in question, it becomes more complex if there is still a mortgage on said house. In the event of there being no mortgage on the property, the process is simple; an application is made to the Land Registry to register the change once all parties are satisfied with the agreement.
However, when there is a mortgage on the property, consent must be obtained from the lender before the transfer of equity takes place. While the process will usually be fairly quick – a matter of weeks at most – it can take longer if there is a dispute among any of the parties involved. Such a dispute might arise for various reasons, including:
- A new mortgage is being sought
- The current mortgage supplier has to give consent
- Separate representation is required
- Dispute as to the terms of a Will
