The Importance of Writing a Will

It is essential to make a Will so that your estate can be divided up in accordance with your wishes. It is important to know that should you die intestate, there is a real risk that:

  • Your surviving spouse may not inherit everything
  • The family home may have to be sold
  • There will be no automatic entitlement for your unmarried partner
  • Guardians will not have been appointed to look after your children in the event of both parents dying
  • Children could be disinherited unintentionally

If you die without a Will, rather than you deciding what happens with your money, possessions and property, this will be dictated by certain rules – called the Intestacy Rules. They determine who will be appointed as the administrator of your estate and how your assets are distributed. This may be quite different to your own wishes.

Why Use a Solicitor?

While it is possible to make a Will yourself, it is highly recommended that you enlist the help of an expert law firm. This will make the whole process more straightforward and reduce the likelihood of any mistakes being made.

If you do not use a solicitor, there may be a risk that:

  • All formal requirements to make the Will legally valid are not taken into account
  • All money, property and possessions may not pass as you intended
  • You may not understand the full impact that a marriage or divorce, for example, may have on your Will
