What happened: Blackstone Solicitors were instructed by a local hot food business based in Poynton, Cheshire in relation to a dispute with the landlord of the building. Our client reported a gas leak to the landlord and National Grid in September 2015 which resulted in the closure of our client’s business for a number of months. Subsequently, our client suffered significant losses and sought payment of damages from the landlord for: loss of profits, loss of goods, cost of repairs to damaged equipment(s), loss of future profits for the business and damages for inconvenience caused by gas leak.
What Blackstone Did: We pursued the landlord for breach of the lease and a claim for substantive losses. We gathered evidence to support the various limbs of our client’s claim for losses and presented the same to the landlord’s solicitors. From the outset, the landlord’s solicitors denied all responsibility for the losses suffered by our client. Court papers were prepared and sent to the landlord’s solicitors in advance of filing them at Court.
Damages: An out of Court settlement was agreed and our client was paid a five figure settlement for the losses and payment of majority of his legal costs.
Outcome: The matter settled prior to the commencement of Court proceedings to our client’s satisfaction.
