Renewing An Existing Lease
Most tenants have the right to renew their business lease when it ends. However, there are certain tenants who do not have this right.
Business tenancies without renewal rights
You do not have automatic renewal rights if:
- you’re a farm business tenant
- you’re a mining tenant
- you’re a service tenant employed by the landlord
- you’re on fixed-term tenancy of 6 months or less
- you waived your right to renew at the start of your lease
Is it possible for a landlord to refuse to renew a lease?
A landlord may oppose to a tenant-initiated lease renewal, but they must explain why and on what grounds, in accordance with the landlord and tenant act 1954.
A landlord cannot object to a lease renewal just because the tenant is unsatisfactory. However, if they do not wish to provide a new lease, they must issue a counter notice within two months stating the reason for their refusal.
There are various grounds for this, but the two most common are as follows:
- Landlord requires space for its own business.
- Property redevelopment

Is it possible for a landlord to initiate a lease renewal?
If you are a landlord seeking to extend a lease, you must serve a ‘Section 25’ notice on your tenant between six and twelve months before to the lease’s termination date. If the lease is being extended, you must provide a future date that is at least six months after the notice is issued.
This notice must specify unequivocally your proposed new terms or the reason you are NOT issuing a new lease. In theory, if a tenant objects to the new conditions and the parties are unable to reach an agreement, either party may petition the court to render a ruling and establish ‘fair’ terms.
Is it possible for a tenant to initiate a lease renewal?
If you are a tenant interested in initiating the lease renewal procedure, you must serve a ‘Section 26’ notice on your landlord between six and twelve months prior to the planned start date of the new lease. While a tenant is legally permitted to suggest terms, if both parties cannot agree on what is ‘fair,’ either party may petition the court to impose them.
In actuality, even if renewal conditions cannot be agreed upon, it is extremely rare for proceedings to end up being resolved in court.
