Sanctions Law

The imposition of international sanctions is a method used by a country or state against another country, state or organisation with the intention of applying political or economic pressure in order to protect national security interests, or to protect international law, and defend against threats to international peace and security. Sanctions will often include the temporary imposition on a target of economic, trade, diplomatic, cultural or other restrictions that are lifted when the motivating security concerns no longer apply, or when no new threats have arisen.

According to Chapter VII of the United Nations Charter, only the UN Security Council has a mandate by the international community to apply sanctions (Article 41) that must be complied with by all UN member states (Article 2,2). They serve as the international community’s most powerful peaceful means to prevent threats to international peace and security or to settle them.

It should also be noted that sanctions can unilaterally be imposed by one country against another without the backing of the United Nations.

Blackstone Solicitors provides a wide range of expert legal services to companies and individuals looking to trade across borders. Every company operating across these borders needs to plan for the potential effect of sanctions on their business, how to manage the risks, and how to position itself to operate safely by taking decisions that make business sense. Companies that properly formulate their objectives, plan their strategy and implement it well will benefit from being in a better position to navigate sanctions when they hit and often have a competitive advantage.
